1. Acceptance of Terms

By accessing or using PhonoPair, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2. Description of Services

PhonoPair provides web-based tools and API services for:

• Generating phonetically similar word pairs for branding purposes
• Analyzing linguistic patterns and phonetic relationships
• Checking domain name availability
• Screening for potential trademark conflicts
• Accessing dictionary and linguistic data via API

3. User Accounts and Registration

To access certain features of PhonoPair, you may be required to register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

4. Subscription Plans and Payment

PhonoPair offers various subscription tiers with different API access limits and features. By subscribing to a paid plan, you agree to:

• Pay all fees associated with your selected subscription tier
• Provide accurate and complete billing information
• Authorize automatic recurring charges unless you cancel
• Acknowledge that subscription fees are non-refundable except as required by law

We reserve the right to change subscription pricing with 30 days' notice to existing subscribers. Price changes will not affect your current billing cycle.

5. API Usage and Rate Limits

Your use of PhonoPair APIs is subject to rate limits based on your subscription tier. You agree to:

• Respect all rate limits and usage quotas for your subscription level
• Not attempt to circumvent or bypass rate limiting mechanisms
• Not use automated systems to make excessive API requests
• Not share your API credentials with unauthorized parties
• Monitor your API usage to avoid exceeding your plan limits

Violation of rate limits or abuse of API access may result in temporary suspension or permanent termination of your account without refund.

6. Use License and Restrictions

Permission is granted to use PhonoPair services for lawful purposes only. This license does not permit you to:

• Modify, copy, or create derivative works of our software or algorithms
• Reverse engineer, decompile, or disassemble our services
• Remove any copyright, trademark, or proprietary rights notices
• Use our services to create competing products or services
• Resell, redistribute, or sublicense access to our services
• Use our services for any illegal or unauthorized purpose
• Transmit any viruses, malware, or harmful code

7. Intellectual Property Rights

All content, features, and functionality on PhonoPair, including but not limited to text, graphics, logos, algorithms, software, and linguistic data compilations, are owned by PhonoPair or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

Word pairs and brand names generated through PhonoPair are provided for your use. However, PhonoPair makes no claim of ownership over the generated output. You are responsible for conducting appropriate searches and clearance before using any generated names commercially.

8. Third-Party Services and APIs

PhonoPair integrates with various third-party services including dictionary APIs, domain registrars, and trademark databases. Your use of these integrated services may be subject to additional terms and conditions imposed by those third parties. PhonoPair is not responsible for:

• The availability or accuracy of third-party services
• Changes to third-party APIs or data sources
• Privacy practices of third-party service providers
• Costs or fees charged by third-party services

9. Content and Data Accuracy

PhonoPair provides linguistic analysis, domain availability checks, and trademark screening as informational tools only. We make reasonable efforts to ensure accuracy but do not guarantee:

• The completeness or accuracy of linguistic analyses
• Real-time accuracy of domain availability information
• Comprehensive trademark conflict detection
• The suitability of generated names for your specific purposes

You are solely responsible for verifying the availability and legality of any brand names before use.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. PHONOPAIR EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

PhonoPair makes no warranty that:

• The services will meet your requirements
• The services will be uninterrupted, timely, secure, or error-free
• Results obtained from the services will be accurate or reliable
• Any errors in the software will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PHONOPAIR, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the services
• Any conduct or content of any third party on the services
• Unauthorized access, use, or alteration of your transmissions or content
• Any trademark conflicts or legal disputes arising from generated names

IN NO EVENT SHALL PHONOPAIR'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO PHONOPAIR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless PhonoPair and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

• Your violation of these Terms of Use
• Your use of the services
• Your violation of any third-party rights
• Any trademark or intellectual property disputes

13. Termination

We may terminate or suspend your account and access to services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination:

• Your right to use the services will immediately cease
• We may delete your account data after a reasonable period
• You remain liable for any fees owed prior to termination
• Provisions regarding liability and indemnification survive termination

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the service. Your continued use of PhonoPair after such modifications constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PhonoPair operates, without regard to its conflict of law provisions.
